John R. Wirthlin

Biography

John Wirthlin focuses his practice on complex commercial litigation matters, with a specific concentration in consumer financial services. As a member of the firm’s Financial Institutions Litigation and Regulatory Compliance (“FILARC”) group, he focuses on a variety of consumer financial services litigation matters, including the defense of claims and counterclaims against corporate defendants, lenders, and loan servicers under RESPA, TILA, and FDCPA federal claims, and state UDAAP claims.

John handles all phases of litigation: pleadings, discovery including depositions, dispositive motions, trials, and appeals. He has won cases for clients at the trial and appellate levels. In addition, he represented one of the top ten largest credit unions in the country in an AAA arbitration involving a loan purchase agreement that resulted in the collection of approximately six million dollars for the client.

John is the FILARC group’s supervising attorney for Ohio and Kentucky. He is licensed and admitted in all federal and bankruptcy courts in both states.

He has successfully defended priority disputes in foreclosures concerning priority of liens and enforceability of mortgages, and handled many commercial lawsuits based upon various causes of action, including breach of contract, fraud, and conversion.

John also has experience with Uniform Commercial Code litigation, Chapter Eleven/Seven bankruptcy, regulatory compliance, and internal risk reporting. He has provided commercial loan workout support for the special assets department of the largest financial institution in Cincinnati, which includes forbearance agreements, loan purchase agreements, and cognovit complaints.

Professional Activities

John is a board member of Tender Mercies, a local Cincinnati charity providing permanent housing to the mentally ill homeless; a member of the Tri State Association for Corporate Renewal (“TACR”) in Cincinnati; and a member of the Ohio chapter of the Commercial Finance Association.
