Jacquelyn Alena DiCicco counsels her clients on a variety of consumer finance litigation matters, including disputes under TILA, RESPA, FCRA, ECOA and FDCPA, state law UDAP claims, and a variety of common law claims.
Ms. DiCicco is also experienced in all areas of matrimonial and family law, including child custody/visitation, child support, orders of protection, relocation, adoption, and equitable distribution of assets.
During law school, Ms. DiCicco was a member of Phi Alpha Delta law fraternity and the Family Law Society. She received numerous CALI awards for academic excellence. Additionally, Ms. DiCicco served as a legal intern for the Touro Law Center Family Law Clinic and as a judicial intern for the Honorable Richard Hoffman of Suffolk County Family Court.
- Defeated borrower’s challenge, on appeal to the Appellate Division, Second Department, to Plaintiff’s standing as the holder of the original note at commencement of the action on the basis that Plaintiff’s Affidavit in Support of Summary Judgment was not hearsay, was admissible evidence, and was sufficient to establish standing.
- Defeated borrower’s challenge, on appeal to the Appellate Division, Second Department, seeking to amend her answer to the complaint to include the defense that Plaintiff lacked standing and successfully established Plaintiff’s standing to foreclose by providing sufficient evidence of physical delivery of the note prior to commencement.
COMMUNITY SERVICE & AFFILIATIONS
Ms. DiCicco has taught religious education at her local parish, Holy Rosary in Bronx, New York. She also often volunteers at soup kitchens.
