Craig Flanders concentrates his practice on complex commercial litigation. Mr. Flanders has substantial experience in successfully prosecuting and defending a wide variety of litigation and arbitration matters from inception through trial and appeal in federal and state jurisdictions throughout the United States and abroad.
Mr. Flanders is regularly called upon to argue a variety of dispositive and non-dispositive motions and appeals, previously appearing in front of the Second, Third, and Ninth Circuits as well as the New York Supreme Court Appellate Division. He is routinely retained as local counsel or co-counsel by law firms through the United States and abroad.
His practice encompasses sophisticated international and domestic commercial disputes spanning complex breach of contract, trade secret, trademark, copyright, antitrust, franchise, business torts, maritime, employment, product liability, insurance coverage, real estate, creditor-debtor and other issues, often involving cross-border litigation or transactions.
Mr. Flanders handles matters for a range of clients from startups to some of the largest companies in the world, including manufacturers and distributors, retailers, restaurant and hospitality industry companies, alternative energy companies, construction contractors, fashion and luxury goods brands, logistics companies, financial institutions, hedge funds, private equity funds, and individuals engaged in commercial and private transactions.
Mr. Flanders is often called upon by clients to bring a litigator’s perspective to bear on various commercial transactions, including mergers and acquisitions, corporate formation and structuring, and a variety of commercial contracts.
During law school, Mr. Flanders served as an editor of the University of Missouri Law Review.
- Represent an international luxury goods brand in a case involving Lanham Act, unfair competition, trade secret, and breach of contract claims against a U.S. licensee and distributor prevailing on a series of dispositive and non-dispositive motions in ongoing litigation.
- Defend a large multinational company against Robinson Patman Act and New Jersey Franchise Practices Act claims, procuring summary judgment dismissal of all claims, a ruling upheld in large part by the Third Circuit Court of Appeals in ongoing litigation.
- Successfully represented individual in real estate dispute against New York City building owner resulting in damages judgment in favor of client and significant ruling from the New York Appellate Division, First Department, ordering statutory and attorneys’ fees of more than twenty times the underlying damages.
