David Yang counsels companies in all phases of the federal procurement process and has represented clients of all sizes and industries in investigations, litigation, and other matters involving a multitude of defense and civilian agencies.
Mr. Yang regularly advises clients on contract formation, administration, compliance, and regulatory matters regarding government audits and investigations, internal investigations, conflicts, ethics, and procurement integrity, suspension and debarment, mandatory disclosures, cost and pricing, intellectual property and data rights, multiple award schedule contracting, claims, prime-subcontractor negotiations and disputes, terminations, the Foreign Corrupt Practices Act, the False Claims Act (“FCA”), the Truth in Negotiations Act, the Buy American Act, and the Trade Agreements Act.
In addition to his counseling work, Mr. Yang litigates cases on behalf of government contractors before a diverse range of government tribunals and in arbitrations before the American Arbitration Association. He has successfully protested and defended procurements worth billions of dollars in pre-award and post-award bid protests before the U.S. Government Accountability Office, the U.S. Court of Federal Claims, and procuring agencies, and has recovered millions of dollars in Contract Disputes Act claims before the boards of contract appeals. Mr. Yang also defends contractors in FCA cases in federal courts nationwide and has strategically obtained dismissal of several multimillion-dollar FCA lawsuits through the effective and efficient use of pre-trial motions.
Mr. Yang served as a law clerk for the Honorable Mary Ellen Coster Williams at the U.S. Court of Federal Claims in 2004. He was associated with a law firm in Washington, D.C., from 2004 to 2005, where he handled a wide variety of civil litigation and government contract matters. From 2005 to 2008, Mr. Yang was an associate with an Am Law 100 firm in Seattle, where his practice focused on defending FCA matters and product liability defense. In law school, he was a member of the law review and the Order of the Coif.
