Jessica A. McElroy

Biography

Jessica McElroy handles a wide range of consumer financial services litigation matters, including disputes arising under TILA, RESPA, FCRA, and FDCPA state law UDAP and RFDCPA claims; and a variety of common law claims.

Before joining Blank Rome, Jessica served as a judicial extern for the Hon. Margaret M. Mann in the U.S. Bankruptcy Court in San Diego, California.

During law school, Jessica served as an executive editor of the San Diego Law Review and received the American Bankruptcy Institute Medal of Excellence.

Experience

  • Assisted in obtaining judgment in favor of loan servicer following weeks’ long jury trial in case involving wrongful foreclosure and promissory estoppel.

  • Obtained summary judgment in multiple actions brought under California’s Homeowner Bill of Rights.

  • Obtained favorable settlements in cases involving credit reporting claims brought under the FDCPA and RFDCPA.

  • Obtained an early dismissal before filing of an answer by way of demurrer or motion to dismiss in numerous actions filed by borrowers against lenders and/or loan servicers.

  • Obtained favorable settlement, including release of fraudulently recorded deed of trust, in elder abuse case.
